Bristol Circuit Court Judge Sage B. Johnson dismissed a lawsuit seeking to evict Bristol Women’s Health, an abortion clinic, from the building it has occupied for over two years due to allegations of fraud. Kilo Delta filed the lawsuit 6 months after the lease went into effect, claiming the clinic did not reveal that abortions would be performed on site and professional losses. The Cardinal News reports Judge Johnson ruled the building owners waited too long to file the lawsuit. However, the judge still needs to rule on a counterclaim filed by the clinic owner’s attorney seeking an injunction to prevent eviction, which is still pending. The clinic owner sees the dismissal as a victory and denies any allegations of fraud.
