There were a total of eight deputies charged for restraining Otieno after he was transferred from Henrico County Regional Jail West to Central State Hospital in Dinwiddie County last year. He died shortly after. WRIC-TV reports Otieno's mother is speaking following the judge's decision, calling it "radical and reckless."Preview: The judge ruled that charges against five of the deputies will be dismissed for now, only brought back if the state chooses to do so. Charges against three deputies are still pending. An attorney for Otieno's family says they want federal prosecutors involved in the case.
