A former Fairfax County police officer is trying to avoid an involuntary manslaughter conviction by using an unusual defense. Wesley Shifflett was charged after he shot and killed an unarmed shoplifting suspect last year. Shifflett's lawyers tried to get the case dismissed yesterday by saying the former police officer intended to kill the suspect because he thought the man was armed. Since the shooting was intentional, Shifflett's lawyers argued that their client couldn't be found guilty of involuntary manslaughter. The judge called the argument "peculiar" before denying the request to dismiss the case.
The Virginia Department of Health is advising the public to stay out of natural bodies of water such as lakes and streams following Helene. The agency noted yesterday that pollution and debris washes into rivers, lakes, streams and coastal waterways following severe storms. Risks to health include pet and livestock waste, untreated sewage and other types of pollution.
